We hereby notify you of the following work requirements for the full implementation of self-owned workers' construction in dangerous projects:

Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, we will fully implement the spirit of the Party's 20th National Congress, adhere to the people's supremacy and life, adhere to overall development and safety, adhere to "safety first, prevention first, and comprehensive management", and deeply learn lessons from the quality and safety accidents that have occurred in recent years, firmly establish the bottom line thinking and red line awareness of safe production, and further consolidate the responsibility for safe production, strengthen safety production risk management and control, fully implement self-owned worker construction in hazardous projects, resolutely prohibit unlicensed personnel, temporary personnel, and idle personnel from entering hazardous projects to operate on site, and reduce illegal command, illegal operations, and violations of labor discipline. Ensure that hazardous project operators have received professional skills training, have corresponding skill levels, safety awareness and emergency response capabilities, fundamentally prevent and curb quality and safety production accidents. Adhere to the system of holding certificates and training before taking up the post, and strive to build a team of high-quality construction enterprises that understand technology, safety, and management, so as to provide strong talent support for the sustainable and healthy development of the construction industry.
Full Implementation of Self-owned Workers' Construction in Dangerous Works in 2.
(I) lay a solid foundation for safe production
1. Clarify the scope of the dangerous project. Dangerous large-scale projects refer to the sub-projects of housing construction and municipal infrastructure projects that are likely to cause mass casualties or major economic losses during the construction process. In accordance with the Regulations for the Implementation of the Safety Management of Sub-divisional and Sub-divisional Projects with Larger Risks in Chongqing (2022 Edition) (Yu Jian Zhi An [2022] No. 110), large and dangerous projects include: 11 types of foundation pit works, landslide treatment and high slope works, foundation works, large temporary works, bridge and culvert works, formwork works and support system, lifting and lifting and lifting machinery installation and disassembly works, scaffolding works, demolition works, underground excavation works and others (see Annex for details).
2. Implement the construction method of its own workers. Conscientiously implement the "Regulations on Safety Management of Dangerous Partial Projects" (Order No. 37 of the Ministry of Housing and Construction), strictly control high-risk operation links, and fully implement the construction method of self-owned workers for dangerous projects. The identification of self-owned workers on the project shall be implemented in accordance with the requirements of the "Notice on Cultivating Self-owned Workers of Construction Enterprises in the New Era to Further Increase Incentives for Pilot Enterprises and Self-owned Workers" (Yu Jian Guan [2023] No. 152). If the construction unit does not have its own workers or its own workers cannot meet the construction needs of dangerous and large projects, it shall subcontract the dangerous and large projects to enterprises with its own workers according to law, or subcontract the labor work to professional operation enterprises with operation qualifications and own workers according to law, so as to ensure that the on-site operators of dangerous and large projects take up their posts with certificates, receive professional training, sign labor contracts and purchase social insurance.
3. Implement the whole process control. Strict real-name management, further establish and improve the quality and safety management and control system of dangerous large projects, and implement the whole process control of dangerous large projects. All participating units of the project shall continuously strengthen quality and safety management, improve management processes, refine management contents and strict management procedures, implement the construction of their own workers in the preparation, review, demonstration, approval and acceptance of special plans for major projects, clarify the number and types of their own workers, and make records of corresponding words, data and photos on the construction site to ensure that the safety risks of major projects are controlled, strictly prevent quality and safety accidents.
4. Increase the cost of safe and civilized construction. Increase investment in safe and civilized construction of self-owned workers in dangerous and large projects, ensure working conditions and living environment, and build a strong line of defense for safe production. Dangerous large projects using its own workers construction, dangerous large project sub-item safety civilization construction fee on the basis of the original charging rate increased by 15%, more than a certain scale of dangerous large project sub-item safety civilization construction fee on the basis of the original charging rate increased by 20%. If the dangerous project does not use its own workers for construction, the safe and civilized construction fee will not be increased.
(II) Strengthening the Management of Own Workers' Organizations
1. Adhere to the certificate. The participating units of the dangerous large-scale project shall earnestly implement the main responsibility of the skill training of their own workers, establish and improve the training system and training files of their own workers, and their own workers shall be allowed to enter the site of the dangerous large-scale project after passing the skill training examination and holding the vocational skill level certificate issued by the relevant industry authorities in our city.
2. Hold on to safety training. The participating units of dangerous and large engineering projects shall strengthen the education and training of production safety, strictly implement the annual safety training for all employees of the enterprise, the "three-level safety education" and the "three-type personnel" safety training system for new personnel, and those who fail to pass the examination without education and training or education and training shall not take up their posts. The construction unit shall formulate a training plan for the scope of work involved in the dangerous and large-scale project, organize and carry out training work, and ensure that its own workers have the knowledge and skills required for construction operation, safety protection and emergency disposal of relevant posts; Before the operation of the dangerous and large-scale project, the construction site management personnel shall make safety technical disclosure to their own workers, including engineering risk analysis, safety specifications and operating procedures, the use and maintenance of safety equipment, safety accident case analysis, etc., and constantly improve the safety operation skills and self-protection ability of their own workers, effectively prevent and contain the occurrence of safety accidents.
3. Strengthen the protection of rights and interests. The construction unit shall sign labor contracts with its own workers in accordance with the law, pay social insurance, strengthen organization and management, and continuously improve the wages of its own workers. Open up career promotion channels, multiple channels to help self-owned workers enjoy more stable jobs, better economic income, more reliable social security, more adequate living benefits, and richer spiritual and cultural life, and promote the professionalization and industrialization of migrant workers, So as to enhance the sense of gain, happiness, and security of self-owned workers.
3. compaction safety production responsibility
(I) construction units strictly implement the primary responsibility for safe production
1. Build up the awareness of high quality and good price. As the general lead unit of project construction activities, the construction unit is the first person responsible for project quality. It should firmly establish the awareness of "century-old plan, quality first", adhere to the concept of high quality and high price, actively support and vigorously promote the construction of its own workers, and implement high quality and high price incentives. In the preparation of the project estimate (pre-calculation), the safety and civilization construction costs, staff education funds should be included in the construction and safety project cost, into the project estimate cost. Construction units should be encouraged and supported to strive for a good grade of site standardization or a safe and civilized construction site in Chongqing. If the site standardization rating is excellent, the safe and civilized construction fee will be increased by 10% according to regulations. If the project is assessed as a safe and civilized construction site in Chongqing, the safe and civilized construction fee will be increased by 20% according to regulations.
2. Strengthen the bidding management. For large-scale projects, the construction unit shall organize survey and design units to list large-scale projects in the construction bidding documents before bidding, make it clear that large-scale projects should fully implement the construction method of their own workers, and require the construction unit to further improve the corresponding safety management measures and refine the types of work and number of their own workers. In the bidding documents, the construction unit shall separately list the safety and civilized construction fees and staff education funds as non-competitive fees and shall not participate in the downward floating.
3. Strict program approval. When examining and approving the special construction plan for large-scale projects, the construction unit shall not approve and approve the relevant items of its own workers or the number of its own workers cannot meet the construction requirements of large-scale projects. In the implementation stage of the plan, the construction unit shall be urged to organize the construction in strict accordance with the special construction plan for large-scale projects, and shall not modify and adjust the special construction plan without authorization.
4. Implementation of payment responsibilities. The construction unit shall pay the safe and civilized construction fees and staff education funds in a timely manner in accordance with relevant regulations. After signing the construction contract and before the commencement of the project, 50% of the safe and civilized construction fee shall be allocated to the construction unit, and the remaining safe and civilized construction fee shall be paid according to the construction progress. When the project is settled, the construction unit shall provide its own workers' construction-related supporting materials, and the construction unit shall settle the settlement according to the actual situation. If the construction of self-owned workers is not adopted or the number of self-owned workers does not meet the relevant requirements of the special plan, the corresponding safe and civilized construction fee shall be deducted.
(II) Supervision Units Strictly Implement Safety Production Supervision Responsibility
1. Strict programme review. When reviewing the special construction plan of the dangerous and large-scale project, the supervision unit shall not sign it if it finds that the relevant contents of its own workers are missing or the number of its own workers cannot meet the construction requirements of the dangerous and large-scale project.
2. Strengthen process supervision. The supervision unit shall carry out special inspection on the construction of its own workers in dangerous and large projects, urge the construction unit to organize its own workers to carry out construction in strict accordance with the special construction plan, and shall not modify and adjust the special construction plan without authorization. If it is found at the construction site that the operators of dangerous and large projects are not self-owned workers or do not hold certificates, the construction unit shall be required to rectify immediately; if the circumstances are serious, they shall be required to suspend construction and report to the construction unit in a timely manner. If the construction unit refuses to rectify or does not stop the construction, the supervision unit shall promptly report to the construction unit and the project safety supervision agency.
(III) the construction unit to strictly implement the main responsibility of safety production
1. Do a good job in the preparation of special programs. The construction unit shall prepare a special construction plan for dangerous and large projects in accordance with the principles of scientific, reasonable, practical and feasible, and specify the type of work and number of workers to be constructed by its own workers in the staffing of the operation. At the same time, the division of labor and safety responsibilities of construction management personnel, full-time safety production management personnel and special operation personnel in the production of dangerous and large projects are clearly defined in the plan, so as to ensure that there are rules and regulations to follow in the process of construction and inspection of dangerous and large projects.
2. Strengthen personnel to perform their duties. The construction unit should earnestly implement the system of the person in charge of the enterprise and the person in charge of the project on the construction site. During the construction of a dangerous project, the person in charge of the project shall perform his duties at the construction site, and the full-time safety production management personnel of the project shall conduct on-site supervision, strictly follow the special construction plan, organize the construction of his own workers, and shall not modify and adjust the special construction plan without authorization.
3. Participate in work injury insurance in accordance with the law. The construction unit shall participate in work-related injury insurance for project employees and pay work-related injury insurance premiums in accordance with the law. The payment rate of industrial injury insurance premium shall be subject to floating management. If the incidence of industrial injury is low and the income and expenditure ratio of industrial injury insurance premium is reduced, the payment rate shall be floated. Encourage construction units to handle accidental injury insurance and other commercial insurance for employees, effectively protect the rights and interests of employees, and reduce the risk of employers.
4. Strengthen the construction of smart site. Construction units should strengthen the construction of intelligent site, the use of information, intelligent means, and effectively improve the level of safety management and control. Management measures such as video surveillance should be taken for large and dangerous projects, and early warning prompts from system feedback and security risks discovered by video should be disposed of in a timely manner to prevent and resolve security risks. At the same time, in the real-name management platform, timely maintenance and update of employees' attendance records, salary payment, education and training and other information.
(IV) industry authorities should strictly implement the responsibility of safety production supervision
All district and county housing and urban construction committees, human resources and social security departments, state-owned regulatory agencies, trade unions and relevant units should further improve their ideological understanding, enhance their sense of responsibility of "always worrying", earnestly put the safety management of dangerous projects in an important position from the height of stressing politics, and urge all parties involved in the construction of the project to strictly implement the safety management regulations of dangerous projects. Efforts should be made to improve the safety management and control system of dangerous projects, effectively prevent and curb the occurrence of quality and safety accidents, effectively safeguard the safety of people's lives and property, and ensure the continuous stability of the construction safety situation in our city. The housing and urban rural development committees of all districts and counties shall, in combination with daily quality and safety supervision, quality and safety "four no two direct" inspection and "cross inspection", strengthen the supervision and inspection of dangerous projects and dynamic verification, adhere to "zero tolerance" for those who find potential safety hazards in dangerous projects during the inspection, and order the responsible units to rectify within a time limit. If the rectification is not in place, it shall be seriously investigated and dealt with according to law.
The Municipal Quality and Safety Station and the Municipal Housing and Construction Law Enforcement Corps should strengthen the supervision and guidance of the housing and urban-rural construction committees of all districts and counties. Quality and safety supervision departments and law enforcement departments at all levels should step up efforts to investigate and deal with violations of laws and regulations in dangerous and large projects, and if the following acts are found, the relevant units and personnel should be seriously investigated for their responsibilities in strict accordance with the regulations on the Safety Management of divisional and sub-divisional projects with greater risk (decree No. 37 of the Ministry of Housing and Construction):
1. If the construction unit fails to list the dangerous major projects in the bidding documents, or fails to pay the safe and civilized construction fee of the dangerous major projects in a timely manner as agreed in the construction contract, it shall be punished in accordance with Article 29 of the Regulations on the Safety Management of Sub-projects with Greater Risks.
2. If the construction unit fails to organize the construction in strict accordance with the special construction plan, or modifies the special construction plan without authorization, or fails to make plan disclosure and safety technical disclosure to the construction site management personnel and operators, it shall be punished according to Articles 33 and 34 of the Regulations on Safety Management of Partial and Subdivisional Projects with Greater Risk.
3. If the supervision unit finds that the construction unit has not implemented the special construction plan, has not required it to rectify or stop work, or has not carried out special inspection on the construction of dangerous projects, it shall be punished according to Articles 36 and 37 of the Regulations on Safety Management of Partial Projects with Greater Risks.

All departments at the two levels in the urban area and all participating units of the project should further improve their understanding of the importance of safe production and the cultivation of their own workers, firmly establish the concept of high-quality development, take positive actions, boldly innovate, fully implement the construction mode of their own workers in dangerous projects, establish and improve the responsibility system of safe production, deepen the reform and innovation in the field of safe production, and build a long-term mechanism of safe production, Let the construction industry employees achieve decent work, enhance the sense of responsibility of the master, stimulate their enthusiasm, initiative and creativity, and effectively prevent and control major security risks.
(II) focus on demonstration and guidance. All district and county housing and urban construction committees, human resources and social security departments, state-owned regulatory agencies, trade unions and relevant units should promptly summarize and promote the advanced experience and practices of implementing self-owned workers in dangerous projects, and strengthen the creation of safety production demonstrations for dangerous projects. Promote the whole industry to vigorously cultivate the consciousness and enthusiasm of self-owned workers, and continuously improve the quality and safety management level of our city. It is necessary to actively coordinate with the local bidding supervision department, urge the construction unit to specify in the bidding documents and contracts the relevant work requirements for the full implementation of the construction of its own workers for large-scale projects, and do a good job in the supervision and management of the construction of its own workers for large-scale projects from the source of bidding. At the same time, all departments should strengthen cooperation, form a joint force of work, and jointly promote the cultivation of self owned workers of construction enterprises in the new era of our city. In the evaluation of Chongqing construction safety and civilized construction site and Chongqing Bayu Cup Quality Project Award, priority should be given to projects and enterprises that use their own workers.
(III) build migrant workers quality skills upgrading station. We will build a new mechanism for improving quality and skills with trade unions, industry authorities and related industries, comprehensively implement the construction of "migrant workers' quality and skills upgrading stations" for dangerous projects with a construction period of more than one year, establish and improve the system system of "migrant workers' quality and skills upgrading stations", and build the upgrading stations into incubation bases and training bases for enterprises' own workers, Take the way of entering colleges and universities, external experts, etc, through training, assessment, evidence collection and other ways, we will form a mechanism for cultivating and upgrading our own workers, constantly improve the quality and ability of our own workers, further enhance the employment skills of our own workers, and broaden the scope and channels of employment.
(IV) give full play to the leading role of state-owned enterprises. State-owned enterprises should further improve their political positions, strengthen organizational leadership, strengthen political responsibility, incorporate the reform of the construction of the industrial worker team into the enterprise development strategy, give full play to the leading role in promoting the reform of the construction of the industrial worker team, and take the lead in building core technical workers as the backbone. (V) clear time node. This Circular shall come into force as of the date of issuance. All new bidding projects shall be strictly implemented in accordance with the requirements of this notice; for bidding projects that have been started or completed, each construction unit shall actively and vigorously cultivate the enterprise's own workers, and gradually realize the full implementation of the construction of its own workers for dangerous and large projects. For dangerous large-scale projects exceeding a certain scale, as of December 1, 2023, all construction by self-owned workers must be realized; for all dangerous large-scale projects in the city, as of February 1, 2024, self-owned workers must be fully realized. For the increase of relevant safety and civilized construction fees, the construction unit shall provide its own workers' construction-related supporting materials, and the construction unit and the construction unit shall negotiate and settle the settlement according to the actual situation.
If other documents are inconsistent with this notice, this notice shall prevail.
